TERMS OF SERVICE AGREEMENT

PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THIS SITE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES. THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AS OF 11/04/2024.

ACCEPTANCE OF TERMS

The following Terms of Service Agreement (the "TOS") is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with A Top Art, located in Georgia and our subsidiaries and affiliates, in association with the use of the A Top Art website, which includes www.atopart.com, (the "Site") and its Services.

DESCRIPTION OF WEBSITE SERVICES OFFERED

The Site is an e-commerce website:
A Top Art is an e-commerce Art and Gift Store.

All visitors are considered "users" of the Services.

The Services and content are the sole property of A Top Art. The company may modify, update, suspend, or discontinue services at any time without liability. Continued use means acceptance of changes.

Services are provided "AS IS", with no responsibility for delays, failures, or data loss.

PRIVACY POLICY

User data is protected under A Top Art’s Privacy Policy. Users consent to collection and international transfer of data.

GLOBAL USE & EXPORT COMPLIANCE

Users agree to comply with all applicable export/import laws, including U.S. regulations.
Users must not:

  • Be on prohibited/export restriction lists
  • Transfer restricted technologies
  • Use services for weapons-related purposes
  • Violate export laws

USER CONTENT LICENSE

Users retain ownership but grant A Top Art licenses to:

  • Use, display, distribute, and promote submitted content
  • Use media (photos, videos, etc.) for platform promotion
  • Use other content broadly (including sublicensing)

Public areas include forums, boards, etc.

CONTRIBUTIONS

By submitting ideas or suggestions:

  • They are non-confidential
  • Become property of A Top Art
  • No compensation is required

INDEMNITY

Users agree to protect A Top Art from claims arising from:

  • User content
  • Violations of the agreement
  • Misuse of services

COMMERCIAL REUSE

Users may not copy, sell, or exploit any part of the service commercially.

MODIFICATIONS

A Top Art may change or discontinue services anytime without liability.

ADVERTISERS

A Top Art is not responsible for:

  • Deals between users and advertisers
  • Any resulting loss or damage

LINKS

A Top Art is not responsible for third-party websites or content.

PROPRIETARY RIGHTS

All content, software, and materials are protected by intellectual property laws.
Users may not:

  • Copy, modify, reverse engineer, or distribute content without permission

WARRANTY DISCLAIMER

Services are provided “AS IS” and “AS AVAILABLE.”

No guarantees that:

  • Services meet expectations
  • Services are error-free or uninterrupted
  • Results are accurate

Users assume all risk, including data loss.

⚠️ Includes warning about possible epileptic reactions from screen content.

LIMITATION OF LIABILITY

A Top Art is not liable for:

  • Loss of profits, data, goodwill
  • Indirect or consequential damages
  • Unauthorized access or third-party actions

RELEASE

Users agree to release A Top Art from disputes and claims.

FINANCIAL CONTENT DISCLAIMER

Content is for informational purposes only — not investment advice.
Users assume all risk in financial decisions.

EXCLUSIONS

Some legal limitations may not apply depending on jurisdiction.

THIRD-PARTY BENEFICIARIES

No third-party rights are granted under this agreement.

NOTICE

Notices may be sent via email, SMS, website, etc.
Users are considered notified even if access was unauthorized.

TRADEMARKS

All branding and trademarks belong to A Top Art.
Unauthorized use is prohibited.

COPYRIGHT INFRINGEMENT

To report infringement, provide:

  • Signature of rights holder
  • Description of work
  • Location of infringement
  • Contact details
  • Statement of good faith

GENERAL INFORMATION

Entire Agreement

This TOS overrides all previous agreements.

Governing Law

Governed by laws of Georgia, USA.
Disputes handled in Cobb County or U.S. District Court.

Waiver & Severability

Invalid clauses do not affect the rest of the agreement.

Statute of Limitations

Claims must be filed within 1 year.
